Job details
1. Services
1.1 The Company will load, haul and dispose of the items described in the job details (the "Items") using the Company's truck, within its operating hours (6 AM to 10 PM, 7 days a week).
1.2 The Company works from land and does not remove material from the water or from vessels.
1.3 Items not listed are not included unless the Client and the Company agree to add them. That agreement can be made by text or email.
2. Price
2.1 The quoted price is based on the Client's description and photos, and on three things: the type of material, the amount (by volume and, for heavy material, by weight), and the haul distance to the drop-off or disposal site, which covers fuel, vehicle maintenance and any disposal fees.
2.2 Unless the quote says otherwise, it is good for 14 days. The Company will confirm the price with the Client on site before loading.
2.3 If the actual job is materially different from what was described, the Company will give a revised price before continuing. The Client may accept the revised price or decline the additional work. The Client pays the agreed price for anything already loaded.
2.4 Unless the quote says otherwise, the price covers labor, hauling and disposal fees for the agreed Items.
3. Accepted and prohibited items
3.1 The Client confirms that the Items do not include any of the following ("Prohibited Items"): food or food waste; chemicals; paint, stain or finishes; batteries of any kind; fuel, motor oil or other petroleum products; propane tanks or other pressurized containers; asbestos or materials that may contain it; medical, biohazard or sharps waste; ammunition, fireworks or explosives; or any other hazardous, toxic or regulated waste under federal or Louisiana law.
3.2 Appliances that contain refrigerant, tires, electronics and very heavy materials (such as concrete, brick, dirt or roofing) are taken only if listed in the job details and agreed in advance.
3.3 If Prohibited Items are found, the Company may refuse them, leave them on site, or stop the job. The Client is responsible for all costs, fines and damages that result from Prohibited Items that were hidden, mislabeled or not disclosed.
4. Client confirms
By signing or approving this Agreement, the Client confirms that the Client:
- owns the Items, or has the legal right to have them removed and disposed of;
- has authority to give the Company access to the property and, for a business, to sign for the business;
- has given accurate information about the Items, the amount and the access; and
- has told the Company about any known hazards at the site.
5. Access and site safety
5.1 The Client will provide clear, safe access to the Items and a lawful place for the truck to park, and will keep children and pets away from the work area.
5.2 The Client will arrange any permits, building or HOA approvals, gate access, escorts or credentials the site requires (such as a TWIC escort at a secure port facility), and will share the site's safety rules and any required protective equipment ahead of time.
5.3 The Company may refuse or stop any work it reasonably believes is unsafe, such as structural hazards, aggressive animals, biohazards, infestations or loads beyond the truck's safe limits, without penalty.
6. Personal property
6.1 The Client is responsible for removing valuables, cash, documents and personal belongings from the Items before loading.
6.2 Once Items are loaded, ownership passes to the Company and the Items cannot be returned. The Company may recycle, donate or dispose of them as it chooses, in line with the law.
7. Property protection and damage
7.1 The Company will use reasonable care. The Client should point out fragile floors, finishes and anything that must not be touched before work starts.
7.2 The Company is not responsible for:
- damage that existed before the Company arrived;
- damage caused by a condition the Client knew about and did not disclose;
- minor scuffs or marks that can't reasonably be avoided when moving large items through tight spaces the Client asked the Company to use;
- wear or marks on driveways, lawns, curbs or other surfaces where the Client directed the truck to park or drive; or
- damage to the Items themselves.
7.3 The Client should report any damage in writing (text or email is fine) within 48 hours of the job, with photos, and give the Company a reasonable chance to inspect it. The Company may choose to repair it, have it repaired, or pay the reasonable cost of repair.
8. Limitation of liability
8.1 To the fullest extent the law allows, the Company's total liability for any claim arising out of this job is limited to the price paid for the job. The Company is not liable for indirect, incidental, special or consequential damages, such as lost profits or loss of use.
8.2 Nothing in this Agreement excludes or limits liability for intentional or gross fault, or for causing physical injury, where Louisiana law (including Louisiana Civil Code article 2004) does not allow it.
9. Cancellations and delays
9.1 The Client may cancel or reschedule at no charge with at least 24 hours' notice. A later cancellation, or a visit where the Company can't get to the Items, may be charged the trip fee shown in the job details.
9.2 Arrival times are windows. The Company may reschedule for weather, safety, equipment problems, river conditions or other events outside its control, with as much notice as it can give and without liability to either side.
10. Payment
10.1 Payment is due when the job is complete, unless the job details or another written agreement say otherwise.
10.2 Unpaid balances may earn interest from the due date at the rate allowed by Louisiana law. The Client agrees to pay the reasonable costs of collecting an unpaid balance, including attorney fees, to the extent the law allows.
11. Indemnity
The Client will defend, indemnify and hold harmless the Company and its owners, employees and contractors from claims, costs, fines and damages (including reasonable attorney fees) arising from: Prohibited Items the Client included or did not disclose; the Client's lack of ownership of, or authority over, the Items or the property; inaccurate information the Client gave; or the Client's breach of this Agreement. This does not apply to the extent a loss is caused by the Company's own fault.
12. Photos and communications
12.1 The Company may take before and after photos for its records. It will not publish photos showing the Client's address, people, license plates or other identifying details without permission.
12.2 The Client agrees that the Company may contact the Client by phone, text or email about this job. Approvals and changes given by text or email count as being in writing.
13. General
13.1 This Agreement includes our Terms of Service at junktogeaux.com/terms. If they conflict, this Agreement controls for this job.
13.2 This Agreement, the quote and the Terms of Service are the whole agreement for this job. Changes must be in writing, and text or email counts.
13.3 This Agreement is governed by the laws of the State of Louisiana. If any part is found unenforceable, the rest stays in effect.
13.4 Electronic signatures, and approval of this Agreement by text or email, are as valid as a signature on paper. This Agreement may be signed in separate copies.
Signatures
By signing, both sides agree to this Agreement.
